Last Updated: 03/15/2024
At Silver Rapid, we respect the intellectual property rights of others and are committed to complying with the provisions of the Digital Millennium Copyright Act (“DMCA”). This DMCA Policy (“Policy”) outlines our procedures for responding to notices of alleged copyright infringement and our obligations as an Internet Service Provider (“ISP”). By using our services, you agree to comply with this Policy.
- Notice of Infringement
If you believe that your copyrighted work has been infringed upon on our network, you or your authorized agent may submit a written notice of infringement (“Notice”) to our designated copyright agent. The Notice must include the following information:
- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material.
- Contact information of the complaining party, including name, address, telephone number, and email address.
- A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Counter-Notification
If you believe that your material has been removed or disabled as a result of mistake or misidentification, you may submit a counter-notification (“Counter-Notification”) to our designated copyright agent. The Counter-Notification must include the following information:
- Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your name, address, telephone number, and email address.
- A statement that you consent to the jurisdiction of the federal district court in which your address is located or, if you are outside the United States, that you consent to jurisdiction in any court of competent jurisdiction.
- Response to Notices
Upon receipt of a valid Notice or Counter-Notification, we will promptly investigate the matter and take appropriate action as required by the DMCA. This may include removing or disabling access to allegedly infringing material or restoring access to material subject to a Counter-Notification.
- Repeat Infringers
We reserve the right to terminate the accounts of users who are repeat infringers of copyright. We may also implement measures to prevent infringing activity on our network, including bandwidth throttling, content filtering, or other technical measures.
